GENERAL TERMS OF RESERVATION

SARL SKI SHOP states on its website www.skishop-avoriaz.com, that its activities focus on the booking and rental of winter sports equipment. SKI SHOP is a limited liability company.

You declare to be at least 18 years of age, and have the legal capacity or hold parental permission to enter into a contract on the website.
You select and book a category of equipment on the website. The equipment shown is not contractual and is only given as an indication to help you in your choice.
The personal information we request from you to rent equipment allows us to know you better. Answering every question is mandatory. The information you share is destined to the renter. The personal information will be automatically erased once the rented equipment is returned and paid for.

 

Your booking is confirmed once you pay a 20% deposit to SKI SHOP. You will pay the remaining balance of the rental directly at the store. The deposit can only be paid on our website through a secured credit card payment system. We only accept credit cards with the initials CB, VISA, EUROCARD or MASTERCARD which were issued in France or within the framework of international networks approved by the GIE Bank Cards. You will be required to select the type of card you wish to use (VISA or Mastercard), then enter the 16 numbers and expiration date on your credit card.

 

Your equipment will be available at the SKI SHOP STORE and ready to use the day before (afternoon) before the beginning of your rental period.
If you are late to return your equipment, please let us know by calling us (04.50.74.10.19) or writing us an email (locations@skishop-avoriaz.com).
Unclaimed equipment on the declared booking date will be made available to other renters. Your  booking will be honored providing the availability of if the equipment.
Your equipment can be changed during your stay if you’re are not satisfied with it or if you want to test other available equipment (no additional cost will be charged if the equipment is in the same price category.


Right of Withdrawal
You have a statutory period for withdrawal of 14 clear days after the receipt of the booking confirmation email. If the deadline occurs over a public holiday or day of closure, it shall be postponed until the first following working day. However, the right of withdrawal can not under any circumstances be exercised after the client has taken possession of his or her booked equipment at SKI SHOP before the 14 clear day delay. All cancelations must be notified by email. The reimbursement will be made within 14 day.

 

Canceling after taking possession of the booked equipment and after the right of withdrawal deadline.

For any other case of cancellation taking place after receipt of the equipment and after the right of withdrawal deadline, the full amount of the deposit is kept as a handling fee by SKI SHOP. However, the deposit may be reimbursed if you provide a justification for an event of force majeure. In this case, the reimbursement will be made within 14 day to the credit card used for the payment.

GENERAL TERMS OF RESERVATION
1. The equipment is delivered in perfect operating condition and is fitted to the renter by the staff.
2. The liability of the renter will be engaged if he or she modifies the equipment settings done by the store staff.
3. The price includes:

  • Maintenance of the rented equipment (excluding waxing).
  • Ski poles

5 In accordance with the signed rental agreement during the receipt of the equipment and/or the condition displayed in the store, the renter authorizes the store to withdraw any outstanding amount from the renter’s provided bank account in the event of a failure to pay the equipment rental cost, the refurbishment costs, or the reimbursement cost.
6 The store will not be held liable for any loss.
Theft or equipment damages can be insured (except for boots, ski poles, helmets, sleds and snowshoes)

7 In the event of the loss of the equipment, the renter undertakes to reimburse the cost of the lost equipment. If you haven’t purchased  an insurance for damage, loss or theft, you agree to pay the full cost of the equipment.

8 In the event of the theft, loss or destruction of the equipment, the renter undertakes to reimburse the cost of the said equipment and the outstanding invoice amount agreed upon during the reception of the equipment.
9 In the event of the loss of the equipment, the renter must file a complaint to the competent authorities (gendarmerie) and fill up an insurance claim which can be found in the store.

10 If purchased, the insurance policy includes a deductible which has to be paid on the following basis by the renter:

– Junior Category 25€ – Category **** 290€

– Category * 50€ – Gold Category 990€

– Category ** 80€

– Category *** 110€

11 The renter declares to have acknowledged the different rental fees.

12 The rented equipment must be returned during store’s opening hours.

13 In case of dispute: this rental contract shall be governed exclusively by French law.

 

 

In case of a dispute:

  1. the renter has to communicate the dispute to the concerned through a registered letter.
  2. consumer mediators will be summoned: MEDICYS, 73, Bd de Clichy, 75009 Paris or on the website

www.medicy.fr

  1. Ultimately, the Thonon-les-Bains (74) Court shall have sole competence.

CONDITIONS GÉNÉRALES DE LOCATION

1 Le matériel est livré en bon état de fonctionnement et adapté au locataire par les soins du bailleur.

2 Toute modification par l’utilisateur des réglages effectués par le magasin entraînera la responsabilité de l’utilisateur.

3 Le prix indiqué par le tarif comprend :

– L’entretien du matériel loué, fartage excepté.

– La fourniture des bâtons de ski

4 Le prix indiqué par le tarif est dû en totalité.

5 En cas de non paiement du coût de la location du matériel, ou des frais de remise en état ou de son remboursement, à l’échéance du contrat, le locataire, par la remise préalable de son numéro de carte bancaire ainsi que la date d’expiration de celle-ci, autorise et donne mandat express au magasin, de prélever sur son compte bancaire les sommes qui resteront dûes, conformément au devis (contrat de location) qu’il aura lui-même signé lors de la prise de matériel et/ou aux prix et conditions affichés en magasin.

6 La perte ou la disparition ne peut être assurée.

Le vol ou la casse du matériel peut être assuré (à l’exclusion des chaussures, bâtons, casque, luge et raquettes).

7 En cas de perte, le locataire s’engage à payer le prix du matériel perdu. Si vous n’avez pas souscrit de garantie assurance, en cas de casse, perte ou vol, vous vous engagez à payer la valeur du matériel 

8 En cas de vol, de perte ou de dégradation, le locataire s’engage à payer, outre le prix du matériel volé, perdu ou dégradé, le montant du prix de la location dont il reste redevable du jour de la prise de possession du matériel perdu, volé ou dégradé à celui de la déclaration faite par lui au bailleur.

9 En cas de vol, le locataire doit déposer une plainte aux autorités compétentes (gendarmerie) et remplir une déclaration de sinistre sur imprimé spécifique (ces imprimés se trouvent au bureau du bailleur).

10 Lorsque les garanties sont acquises, l’assurance est assortie d’une franchise, toujours à la charge de l’utilisateur sur la base suivante :

– Catégorie junior 25€ – Catégorie **** 290€

– Catégorie * 50€ – Catégorie or 990€

– Catégorie ** 80€

– Catégorie *** 110€

11 Le locataire déclare avoir pris connaissance du barème des tarifs de location.

12 Le matériel loué doit être rendu pendant les horaires d’ouverture du magasin.

13 Litige : seule la loi Française régit le présent contrat de location.

  

En cas de contestation :

1. Le locataire devra porter le litige à la connaissance du

loueur par lettre recommandée.

2. Il sera fait appel au dispositif de médiation de la consommation

: MEDICYS, 73, Bd de Clichy, 75009 Paris ou sur le site

www.medicy.fr

3. En dernier lieu, seul le Tribunal de Thonon-les-Bains (74)

sera compétent
